1. Your Agreement

1.1 This website, www.thethaitourism.com (the “Platform”), is operated by DMR Corporation Co. Ltd., a company registered in Thailand. Please read these Terms of Use (“Terms”) carefully before using the Platform and the services offered by DMR Corporation Co. Ltd. (collectively referred to as “The Thai Tourism”) or third-party operators (“Operators”) through the Platform (the “Services”). The terms “you” and “your” refer to any person who accesses the Platform or makes a purchase on behalf of others.

2. Changes to Terms of Use

2.1 Modifications by The Thai Tourism

2.1.1 The Thai Tourism reserves the right, at its sole discretion, to change or modify any part of these Terms at any time without prior notice. You should revisit this page periodically to review the current Terms. Updates will be posted on this page with the revised effective date.

2.1.2 Continued use of the Platform following any changes indicates your acceptance of the updated Terms. If you do not agree, you must stop using the Platform and the Services. It is your responsibility to remain informed of any changes.

2.1.3 When using specific Services, you may be subject to additional terms applicable to that Service, and our Privacy Policy. While we do not currently use AI tools, future versions of the Platform may incorporate such features, subject to their own terms of use when introduced.

3. Access and Use of the Services

3.1 Ownership of Content

3.1.1 The Thai Tourism Platform, including its domain name (www.thethaitourism.com), subdomains, features, and content, is owned and operated by DMR Corporation Co. Ltd.

3.2 Provision and Accessibility of Services

3.2.1 Subject to these Terms, The Thai Tourism may offer Services directly or through third-party Operators. Services selected by you are for your personal use only. The Thai Tourism may modify or discontinue Services or features at any time without notice.

3.2.2 We do not guarantee continuous or uninterrupted availability of Services. You are responsible for arranging access and ensuring others using your connection comply with these Terms.

3.2.3 Any linking to the Platform may be revoked at our discretion. Written consent may be required before linking to the Platform.

4. Platform and Content

4.1 Use of the Content

4.1.1 All materials displayed on the Platform—including text, graphics, images, and multimedia—are protected by copyright and other intellectual property laws. These materials are for your personal, non-commercial use only and may not be reused without permission.

4.1.2 Access is granted as a limited, non-exclusive, non-transferable license to use the Platform under these Terms. The Thai Tourism reserves the right to modify or remove content at any time without notice.

4.1.3 You agree not to reproduce, distribute, broadcast, display, sell, license, or exploit any part of the Platform or its content without prior written consent from the rightful owner.

4.2 Liability for Content

4.2.1 The Thai Tourism does not guarantee the identity or accuracy of content shared by other users or Operators. Use of content is at your own risk.

4.2.2 The Thai Tourism is not liable for errors or omissions in content or for any damages resulting from reliance on such content.

4.2.3 Sorting and filtering options on the Platform are designed to improve your experience. We may update these settings periodically to optimize results.

5. Intellectual Property Rights

5.1 Intellectual Property

5.1.1 All intellectual property rights in the Platform and Services are owned by or licensed to The Thai Tourism. You may not modify, distribute, reproduce, or exploit any part of the Platform or Services beyond personal use without permission.

5.1.2 Downloading or copying content is permitted only for personal, non-commercial purposes, and must retain all proprietary notices.

6. User Submissions

6.1 Uploading of Information

6.1.1 By posting content, reviews, or other materials (“User Submissions”) on the Platform, you grant The Thai Tourism and its Operators a worldwide, non-exclusive, royalty-free license to use such content for the purpose of operating and promoting the Services.

6.1.2 You agree to our use of your personal data as outlined in our Privacy Policy.

6.1.3 You grant other users of the Platform a license to view and interact with your User Submissions.

6.1.4 The Thai Tourism may reformat, modify, or translate your submissions. You remain the owner of your content unless otherwise agreed.

6.1.5 You warrant that your submissions do not infringe any laws or third-party rights.

6.1.6 You are solely responsible for your User Submissions.

7. User Representations, Warranties, and Undertakings

7.1 Use of the Platform

7.1.1 You agree not to use the Platform in a way that:
Infringes on third-party rights
Violates any law
Is fraudulent, abusive, or misleading
Involves unauthorized commercial activity
Impersonates another person or misrepresents your identity
Contains harmful software or viruses

7.2 Removal of Submissions

7.2.1 The Thai Tourism reserves the right to remove any User Submission for any reason, including suspected violations of these Terms.

7.3 Responsibility for Submissions

7.3.1 You are solely responsible for your submissions. You confirm that you own or have the rights to all content you post and that it does not violate third-party rights or laws.
7.3.2 You may not use the Platform for fraudulent, speculative, or competitive purposes.
7.3.3 You must not engage in scraping, hacking, or other unauthorized access.
7.3.4 You are responsible for compliance with applicable tax and legal obligations arising from your use of the Platform.

8. Registration and Security

8.1 Account Creation

8.1.1 You may be required to create an account to access certain Services.

8.2 Providing Information

8.2.1 You agree to provide accurate and current information and to maintain the confidentiality of your login credentials.
8.2.2 You may not use a username that misrepresents your identity or infringes on the rights of others.
8.2.3 The Thai Tourism reserves the right to refuse or cancel account registrations at its sole discretion.

9. Reviews, Correspondence, and Rights to User Content

9.1 By completing a booking on The Thai Tourism platform, you agree to receive confirmation notifications (via email and/or app) and may also receive follow-up invitations to submit a review of the activity. Submitting a review is entirely optional. These communications are transactional and are not part of any promotional or marketing emails, from which you may unsubscribe separately. Submitted reviews may appear on the relevant activity page within 72 hours, solely to assist other users in assessing the service quality and experience.
9.2 By submitting a review, you grant The Thai Tourism a worldwide, irrevocable, royalty-free, transferable license to use, display, edit, translate, and publish the review for informational and promotional purposes. We reserve the right to edit, refuse, or remove any reviews at our sole discretion.

9.3 You represent and warrant that:

9.3.1 You own or legally control the rights to any content you submit;
9.3.2 The submitted content is truthful and not misleading;
9.3.3 Posting your content does not violate any law or third-party rights.

9.4 Reviews must not contain profanity, hate speech, offensive material, personal information of others, or content promoting illegal behavior. Irrelevant promotional content, referral or reward links, and spam are strictly prohibited.
9.5 You authorize The Thai Tourism to take legal action against any entity or individual violating our or your rights in the submitted content. You remain solely responsible for any content you submit.
9.6 All user-generated content is treated as non-confidential and may be used, modified, or removed by The Thai Tourism without prior notice or compensation. We are under no obligation to attribute authorship or provide editing rights after submission.

10. Booking Confirmations, Vouchers, Fees, and Payments

10.1 Booking Confirmation

10.1.1 Some services are eligible for instant confirmation, while others may require processing time. Estimated confirmation times are for reference and may vary.

10.2 Vouchers

10.2.1 When you book services via The Thai Tourism platform, you may receive a voucher confirming your reservation. This may include a confirmation number and downloadable or printable voucher depending on the activity.
10.2.2 To redeem your voucher, you must be present at the designated meeting point on time and provide necessary documentation (e.g., ID, confirmation number). Failure to appear or provide required information may result in forfeiture without refund.
10.2.3 In some cases, the Operator may require photo identification. Lost or stolen vouchers and unlawful use (e.g., underage use for restricted activities) will render the voucher invalid without refund.

10.3 Terms of the Vouchers

10.3.1 Each voucher is subject to individual Operator terms, including age or usage restrictions, which are disclosed at the time of booking.
10.3.2 Vouchers are typically for one-time use and may include expiration or date restrictions. Expired vouchers are non-refundable unless otherwise stated.

10.4 Cancellation of Vouchers

10.4.1 You may cancel your voucher within the cancellation window specified at purchase. If eligible, refunds will be processed to your original payment method.
10.4.2 The service provider (Operator) is responsible for honoring or rejecting your voucher. Refunds and complaints should be addressed to the Operator in accordance with their policies.
10.4.3 All prices are listed in your selected currency at the time of booking. Unless stated, fees are non-refundable except in cases of cancellation by the Operator.
10.4.4 If an activity is canceled by the Operator, we will notify you and process a full refund.

10.5 Assistance with Issues

10.5.1 If you're unable to redeem a valid voucher due to Operator error or denial, please contact us at [email protected] for assistance. We will coordinate with the Operator for resolution.

10.6 Additional Charges

10.6.1 The Thai Tourism may apply service charges based on the selected activity. Charges will be clearly displayed before you confirm your booking.

10.7 Price Modifications

10.7.1 Prices are subject to change. We will notify you via email or the Platform in case of any price updates. Continued use of our services implies acceptance of revised pricing.

10.8 Rights and Disclaimers

10.8.1 We reserve the right to cancel bookings or restrict access if a booking is found to violate our policies or terms.
10.8.2 Although Operators are required to provide up-to-date pricing and service details, The Thai Tourism does not guarantee 100% accuracy at all times due to the involvement of third-party providers.
10.8.3 Applicable taxes and local surcharges may not be included in the displayed prices and are your responsibility unless otherwise specified.

11. Discounts, Rewards, and Promotional Offers

11.1 Instant Rewards

11.1.1 The Thai Tourism offers a 5% instant reward on eligible bookings. These reward points are automatically credited to your account and can be used toward future bookings. Points are non-transferable, have no cash value, and may not be used for taxes, fees, or delivery charges.
11.1.2 Reward points are granted only after successful completion of the booked activity and are subject to expiration within 365 days. Cancelled or refunded bookings will result in corresponding reward point deductions.

11.2 Coupons and Promotional Codes

11.2.1 Promotional coupons may be issued via email or directly in your account. These are one-time use only and will not be reinstated once used.
11.2.2 Coupons may be obtained through limited-time offers, referral programs, or other authorized promotional activities.

11.3 Referral Program

11.3.1 The Thai Tourism offers a referral program where users may earn discount coupons or reward points for inviting others to use the platform. Abuse or fraudulent participation will result in cancellation of rewards and possible account suspension.

11.4 Misuse of Discounts

11.4.1 If rewards or coupons are obtained through fraud, technical loopholes, or in breach of these Terms, The Thai Tourism reserves the right to:
(a) Terminate or suspend your account;
(b) Cancel accumulated rewards or coupons;
(c) Deny further use of services.

12. The Thai Tourism Referral Program

12.1 The Program

12.1.1 On the Platform, The Thai Tourism may offer users the opportunity to earn discount coupons or reward points by referring friends to register and make a confirmed booking through an authorized invitation channel (e.g., via the Platform, email, or supported social platforms).

12.2 Terms

12.2.1 You may only earn referral rewards through The Thai Tourism’s official invite mechanisms. Referrals made outside of authorized channels will not be eligible. All rewards are non-transferable and may not be sold, auctioned, or pooled.
12.2.2 Rewards will only be granted for the first successful booking completed by a referred user through a valid invitation. If the invitee does not use the designated referral method, no reward will be issued.
12.2.3 Creating multiple accounts or using alternative identities to gain referrals is strictly prohibited. Any attempt to manipulate or circumvent the referral system may result in forfeiture of rewards and account termination.
12.2.4 You may not create independent promotions or use the trademarks of The Thai Tourism for advertising without explicit written consent.
12.2.5 The Thai Tourism reserves the right to void any referrals and related rewards earned fraudulently, in violation of these Terms, or not in line with the intended use of the referral system.
12.2.6 Referral rewards, when applicable, will be credited to your account or email address within a reasonable time after the invitee completes a qualifying booking.
12.2.7 The Thai Tourism may adjust reward values based on your activity level and reserves the right to modify or terminate the referral program at any time.
12.2.8 The Referral Program is void where prohibited by law. Any tax liabilities arising from the use of rewards are your responsibility. Displayed rewards may not always reflect your actual earned value until verified.

13. Privacy Policy

13.1 For information on how The Thai Tourism collects, uses, and protects your personal data, please refer to our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also agree to the terms outlined in the Privacy Policy.

14. Indemnity

14.1 Your Indemnification

14.1.1 You agree to indemnify and hold harmless DMR Corporation Co. Ltd., its officers, employees, subsidiaries, and affiliates from all claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights by you or any person using your account.

14.2 Platform Involvement

14.2.1 The Thai Tourism may participate in legal defenses or negotiations related to a claim. You may not settle any claim that adversely affects The Thai Tourism without prior written approval. We reserve the right to assume exclusive control over legal matters at our own expense.

15. Disclaimers and Limitation of Liability

15.1 Relationship Disclaimer

15.1.1 You acknowledge that using The Thai Tourism Platform does not establish any fiduciary or special relationship between you and The Thai Tourism. We do not control how you interpret or react to content on the Platform.

15.2 Service and Content Disclaimer

15.2.1 While we strive to present accurate descriptions and service details, The Thai Tourism is not responsible for the content, accuracy, or recommendations provided by Operators or other users.

15.3 Limitation of Liability

15.3.1 Under no circumstances shall The Thai Tourism, its affiliates, officers, employees, or partners be liable for indirect, incidental, punitive, or consequential damages arising from:
(a) Use of the Platform;
(b) Any breach of these Terms;
(c) Reliance on Platform content or Operator services;
(d) Communications or transactions with other users or Operators.
15.3.2 These limitations apply regardless of the legal basis of the claim, including breach of contract, negligence, or tort.
15.3.3 The Platform and its content are provided on an "as is" and "as available" basis. We make no warranties—express or implied—regarding accuracy, functionality, or uninterrupted availability.
15.3.4 You understand that information sent through the Platform may not be secure and that we do not guarantee confidentiality for any transmissions.
15.3.5 You agree not to hold The Thai Tourism liable for content, services, or representations made by third-party Operators. We do not guarantee the safety, accuracy, or legal compliance of listings or transactions on the Platform.

15.4 Remedies

15.4.1 If you are dissatisfied with the Platform or these Terms, your sole remedy is to discontinue use.
15.4.2 Where liability cannot be excluded by law, The Thai Tourism’s total liability to you for all claims will be limited to the lesser of:
(a) The amount paid by you for services in the last 12 months;
(b) THB 20,000 (or equivalent in your local currency).

16. Interaction with Third Parties

16.1 Third-Party Links

16.1.1 The Platform may contain links to third-party websites or services. These links are provided for convenience and do not imply endorsement by The Thai Tourism.
16.1.2 You access third-party websites at your own risk. It is your responsibility to review and comply with their terms and policies.
16.1.3 The Thai Tourism does not control or take responsibility for content, data collection, or business practices on third-party websites.
16.1.4 Transactions between you and third-party providers (such as Operators) are solely your responsibility. We do not participate in, guarantee, or mediate such transactions.
16.1.5 You should conduct your own due diligence before engaging in any transaction with a third-party provider.

16.2 Limitation of Responsibility

16.2.1 The Thai Tourism is not liable for losses, disputes, or claims arising from your interactions with Operators or other third parties. If disputes arise, you release The Thai Tourism and its affiliates from all claims, known or unknown, related to such disputes.

17. Payment

17.1 Currency Handling and Payment Responsibility

To ensure effective support for transactions, including refunds and cancellations (where applicable), DMR Corporation Co. Ltd., as the operator of The Thai Tourism, is responsible for processing transactions in all currencies supported on the Platform. We support a wide range of global currencies, and payments may be accepted via credit/debit cards, bank transfers, or cash (if applicable to the activity type or Operator policy).

17.2 Pay Later Option and Currency Calculations

17.2.1 For certain bookings, The Thai Tourism may offer a "Pay Later" feature, allowing you to confirm a booking on a certain date (“Booking Date”) and pay at a later date (“Payment Date”). Definitions:
• Display Currency: The currency selected by you for browsing the Platform.
• Merchant Settlement Currency: The currency in which The Thai Tourism settles with the Operator.
• Local Currency: The currency applicable to the activity location.
• FX Rate: The exchange rate used for conversions, based on prevailing rates from reliable financial data sources.
17.2.2 If your Display Currency differs from the Merchant Settlement Currency:
• On the Booking Date: The displayed price is only an estimated conversion and may not reflect final amounts due to currency fluctuations.
• On the Payment Date: Final pricing is based on the exchange rate (FX Rate) on that day, and may include an adjustment of up to 5% to cover conversion margins and cross-border transaction costs.
17.2.3 For Pay Later Bookings, you authorize The Thai Tourism to:
• Perform a small verification charge or pre-authorization on your selected payment method on the Booking Date.
• Charge the full amount on the Payment Date without further notice.

17.3 Payment Method Charges

Your bank or payment provider may apply additional fees for currency conversion, international transactions, or taxes. Please consult your payment provider for more details. The Thai Tourism is not liable for such third-party charges.

18. Termination

18.1 Termination by The Thai Tourism

This Terms of Use shall remain in effect while you use the Platform or Services. The Thai Tourism reserves the right to terminate or suspend your account or access to Services at any time, without prior notice, for any reason, including breach of these Terms.

18.2 Effects of Termination

• Your right to use the Platform and Services will immediately end.
• All terms which by nature should survive termination shall continue, including ownership clauses, indemnities, disclaimers, and limitations of liability.
• If your account is terminated for breach of Terms, we reserve the right to cancel any outstanding bookings or vouchers without refund.

19. Passports, Visas, Documents, Licenses & Insurance

19.1 Your Responsibilities

19.1.1 You are solely responsible for verifying visa, passport, and health requirements for your destination by consulting the relevant consulate or embassy.
19.1.2 Requirements may change without notice; The Thai Tourism is not responsible for such updates.
19.1.3 Some Operators may require valid documentation (e.g., driver’s license, insurance, identification) before you can access their services.
19.1.4 We strongly recommend purchasing comprehensive travel insurance before departure.

20. Governing Law

This Terms of Use shall be governed by and construed in accordance with the laws of Thailand. You agree to submit to the non-exclusive jurisdiction of the courts of Thailand in the event of any legal dispute.

21. Miscellaneous

21.1 Severability

If any provision of these Terms is held invalid or unenforceable, that part will be removed or limited to the extent necessary, while the remainder of the Terms shall remain in full force and effect.

21.2 Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent from The Thai Tourism. We may assign or transfer these Terms without notice.

21.3 Language

These Terms are drafted in English and will prevail over any translated versions in case of discrepancies. Translations are provided solely for reference purposes.
